Divorce & Family Law

Compassionate, practical guidance through some of life's most difficult decisions.

You can find basic divorce forms online, but no one should go through a divorce without competent legal counsel. Divorce decrees are very hard to modify later, so it's important to get things right the first time.

Witt Law has years of experience in family law. We understand that every divorce is personal, and we'll work toward a fair outcome that lets you move forward with your life.

A note on cost

Utah now requires divorcing parties to attend mediation. When both sides have disclosed their finances, attend in person, and work with an effective mediator, most cases resolve at or shortly after mediation — which keeps costs more manageable. We also offer discounted initial consultations for divorce matters.

Divorce & Family Law questions in Utah

How long does a divorce take in Utah?
Utah has a mandatory waiting period after filing before a divorce can be finalized, and the total timeline depends on whether the divorce is contested and how complex the issues are. Uncontested cases move faster; contested custody or property disputes take longer.
How is child custody decided in Utah?
Utah courts decide custody based on the best interests of the child. Legal custody concerns decision-making; physical custody concerns where the child lives. Parents often share joint legal custody absent good cause otherwise.
Is mediation required before a Utah divorce?
Utah generally requires divorcing parties to attend mediation before proceeding to trial. Many cases resolve at or shortly after mediation, which keeps costs more manageable.
How is alimony determined in Utah?
Alimony isn't automatic in Utah. Courts look at factors like the financial condition and needs of the receiving spouse, earning capacity, and the length of the marriage, with the general goal of leaving both parties in a similar position. When awarded, it typically won't exceed the length of the marriage.
